At the discussion included an overview of aggregate litigation types and how these legal mechanisms solve problems for both plaintiffs and defendants alike to create a “global peace.”

The most generally well-known of these options is Class Action litigation – in which a group of individuals comes together to address an injustice against a powerful defendant – generally a corporation or a government.

“Class actions are a common sense way to solve a shared problem between those harmed and those in power,” said Mark Chalos, managing partner of Lieff Cabraser Heimann & Bernstein’s Nashville office. “Class action litigation can change the way bad acting companies do business and get compensation for those harmed by wrongful conduct. For companies that believe they have acted properly, class actions can efficiently bring vindication in one fell swoop.”

Another legal mechanism for resolving complex civil cases is by way of multi-district litigation, often referred to as an MDL, which is a system of organizing multiple cases and types of cases against a common defendant (or defendants) in one federal court district for pre-trial proceedings – managed by one judge. Created by Congress in 1968, MDLs benefit plaintiffs, defendants, and American taxpayers by controlling costs, avoiding duplication, and preventing inconsistent pre-trial rulings.

The Southeast Complex Litigation Conference included leading voices from the plaintiffs’ bar, defense bar, government, and the bench, and was presented the Tennessee Bar Association.

Raytheon to Pay $8.4 Million to Settle False Claims Act Allegations Over Cybersecurity Violations in DoD Contracts https://www.braserlieffcasite.top/2025/05/raytheon-false-claims-act-settlement/ Mon, 05 May 2025 21:15:28 +0000 https://www.braserlieffcasite.top/?p=18597 Lieff Cabraser, with co-counsel, represented a whistleblower whose allegations that Raytheon failed to comply with mandatory cybersecurity requirements in Department of Defense contracts and subcontracts led to an $8.4 million settlement with the federal government.

“We are proud to represent whistleblowers—people who take their ethical obligations very seriously and who are often in the best position to observe fraud on taxpayers,” noted Lieff Cabraser partner Rachel Geman, who represents plaintiffs in the case. “We are especially appreciative of our relator’s efforts to maintain cybersecurity and courageous willingness to step forward when problems arose.”

As reported by Law360 (subscription), on April 14, 2025, U.S. District Judge Edward J. Davila of the Northern District of California granted final approval to a $32 million settlement resolving nearly five years of litigation in the Telescope Antitrust Monopoly & Price-Fixing case. The lawsuit, brought by Lieff Cabraser and co-counsel, alleged that several global telescope suppliers engaged in a conspiracy to fix prices and allocate the market for telescopes sold in the United States.

Filed in 2020, the lawsuit accused Celestron and Chinese rival Ningbo Sunny, among others, of conspiring to “fix prices, divide the market, retaliate against competitors, mislead U.S. authorities, illegally acquire assets, and dominate the U.S. market.” According to the complaint, this long-running anticompetitive conduct resulted in hundreds of millions of dollars in overcharges to telescope buyers since at least 2005.

The case was brought on behalf of indirect purchasers—consumers and businesses that bought telescopes from retailers such as Amazon, Costco, BestBuy.com, and others, which in turn sourced telescopes from the defendants. The telescope suppliers named in the lawsuit manufacture, distribute, and/or sell telescopes under brand names including Celestron, Meade, and Sky-Watcher.

As part of the settlement, the class representatives will each also receive $3,000 for their service.
